2. General Information on Data Processing

We process personal data of our users only insofar as this is necessary to provide a functional website and our content and services. The processing of personal data of our users takes place regularly only with the consent of the user. An exception applies in those cases where obtaining prior consent is not possible for factual reasons and the processing of the data is permitted by statutory provisions pursuant to Art. 6 GDPR.

3. Hosting and Provision of the Website

This website is hosted by Cloudflare, Inc., 101 Townsend St, San Francisco, CA 94107, USA (hereinafter "Cloudflare"). Cloudflare acts as a processor within the meaning of Art. 28 GDPR on the basis of a data processing agreement concluded with us.

Each time the website is accessed, our hosting provider automatically collects and stores information in server log files which your browser automatically transmits. The data stored includes: name of the retrieved file, date and time of the retrieval, amount of data transferred, notification of successful retrieval, browser type and version, the user's operating system, referrer URL (the previously visited website), IP address, and the requesting provider. This data is not merged with other data sources. The legal basis for this processing is Art. 6 para. 1 sentence 1 lit. f GDPR, based on our legitimate interest in the technically error-free presentation and optimisation of this website. Log data is deleted after seven days at the latest, unless further storage is required for evidentiary purposes.

Cloudflare may process data in the USA. An adequate level of data protection is ensured through the implementation of Standard Contractual Clauses (SCCs) pursuant to Art. 46 para. 2 lit. c GDPR.

4. Cookies

This website uses cookies. Cookies are small text files which are stored on your terminal device and which store certain settings and data for exchange with our system via your browser. A cookie generally contains the name of the domain from which the cookie file was sent, information about the age of the cookie, and an alphanumeric identifier.

We use technically necessary cookies which are required for the operation of the website. The legal basis for this processing is Art. 6 para. 1 sentence 1 lit. f GDPR based on our legitimate interest in providing a technically functional website.

We furthermore use analysis and marketing cookies which are processed exclusively on the basis of your consent pursuant to Art. 6 para. 1 sentence 1 lit. a GDPR, as granted via our cookie consent management tool. You may withdraw your consent at any time with effect for the future by accessing the cookie settings on this website. The lawfulness of processing operations carried out prior to the withdrawal remains unaffected.

5. Web Analytics via Google Analytics

This website uses Google Analytics, a web analytics service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google"). Google Analytics uses cookies which enable an analysis of your use of this website. The information generated by the cookie concerning your use of this website is generally transferred to and stored on a server of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

We use Google Analytics exclusively on the basis of your consent pursuant to Art. 6 para. 1 sentence 1 lit. a GDPR. IP anonymisation (IP masking) has been activated on this website, meaning your IP address is truncated by Google within member states of the European Union or other contracting states of the Agreement on the European Economic Area prior to transmission. Only in exceptional cases will the full IP address be transmitted to a server of Google LLC in the USA and truncated there.

On our behalf, Google will use the information generated to evaluate your use of this website, to compile reports on website activity, and to provide us with other services relating to website and internet use. The IP address transmitted by your browser within the scope of Google Analytics is not merged with other data held by Google.

Insofar as data is transferred to Google LLC in the USA, an adequate level of data protection is ensured through the implementation of Standard Contractual Clauses (SCCs) pursuant to Art. 46 para. 2 lit. c GDPR. You may withdraw your consent at any time with effect for the future via our cookie consent tool. Furthermore, you may prevent the collection of data generated by the cookie and related to your use of the website (including your IP address) by Google and the processing of this data by Google by downloading and installing the browser plugin available at: https://tools.google.com/dlpage/gaoptout.

6. Appointment Scheduling via Calendly

This website offers the option of scheduling appointments via Calendly, a service provided by Calendly LLC, 271 17th St NW, Ste 1000, Atlanta, GA 30363, USA ("Calendly"). When you book an appointment, the personal data you provide — in particular your name, email address, and requested appointment time — will be transmitted to Calendly for the purposes of appointment organisation and will be processed by Calendly in accordance with its own privacy policy.

The legal basis for this processing is Art. 6 para. 1 sentence 1 lit. b GDPR (performance of pre-contractual measures at the request of the data subject). Insofar as data is transferred to the USA, an adequate level of data protection is ensured through the implementation of Standard Contractual Clauses pursuant to Art. 46 para. 2 lit. c GDPR.

7. Data Processing in Connection with Service Provision and Payment

We collect and process personal data where you provide such data in connection with an enquiry, the initiation of a contractual relationship, or the execution of a coaching or consulting engagement. Mandatory information required for the conclusion of a contract will be indicated as such. Without provision of this data, conclusion of the contract will not be possible.

The legal basis for the processing of data in connection with the initiation and execution of a contractual relationship is Art. 6 para. 1 sentence 1 lit. b GDPR. Where payment transactions are conducted in connection with a service agreement, we may transmit the data required for the processing of the payment transaction to the relevant financial institutions or payment service providers. The legal basis for such transmission is likewise Art. 6 para. 1 sentence 1 lit. b GDPR. Following complete execution of the contract, your data will be restricted from further processing and deleted upon expiry of applicable statutory retention periods pursuant to Art. 6 para. 1 sentence 1 lit. c GDPR, unless you have expressly consented to further use of your data pursuant to Art. 6 para. 1 sentence 1 lit. a GDPR.

8. Contact via Email

Where you contact us by email, the personal data you transmit will be stored by us for the purpose of processing your enquiry and in the event of follow-up questions. The legal basis for the processing of data transmitted in the course of sending an email is Art. 6 para. 1 sentence 1 lit. f GDPR, based on our legitimate interest in processing and responding to your enquiry. Where the email contact is directed towards the conclusion of a contract, the additional legal basis for processing is Art. 6 para. 1 sentence 1 lit. b GDPR. This data will not be disclosed to third parties. Data collected in this context will be deleted once the relevant conversation has concluded and provided no statutory retention obligations preclude deletion.

9. Contact and Communication via WhatsApp Business

This website offers the option of contacting us via WhatsApp Business, a messaging service provided by Meta Platforms Ireland Ltd., 4 Grand Canal Square, Dublin 2, Ireland ("Meta"). WhatsApp Business is operated by WhatsApp LLC, 1601 Willow Road, Menlo Park, CA 94025, USA, a subsidiary of Meta Platforms, Inc.

Data collected and processed: When you initiate contact with us via WhatsApp or when we save your contact details following an initial communication, the following categories of personal data may be collected and processed: your phone number, your WhatsApp display name and profile picture (if set to publicly visible), the content of all messages exchanged, the date and time of each communication, and technical metadata associated with the transmission (e.g. delivery and read receipts).

Storage of your contact details: Where you initiate contact with us, we will save your phone number and, where provided, your name in our WhatsApp Business contact list for the purpose of managing our ongoing communication with you. This storage enables us to attribute future messages to the correct person and to conduct our coaching and consulting services effectively. You may request deletion of your contact data at any time (see your rights below).

Purpose and legal basis: We process your personal data via WhatsApp for the following purposes and on the following legal bases:

· Responding to your initial enquiry: Art. 6 para. 1 sentence 1 lit. f GDPR (legitimate interest in providing accessible communication), and Art. 6 para. 1 sentence 1 lit. b GDPR where the enquiry relates to the initiation of a contractual relationship;
· Conducting pre-contractual and contractual communication: Art. 6 para. 1 sentence 1 lit. b GDPR (performance of a contract or pre-contractual measures at the request of the data subject);
· Ongoing coaching and consulting interaction: Art. 6 para. 1 sentence 1 lit. b GDPR.

Data processing by Meta: Please be aware that Meta processes data independently in connection with the operation of WhatsApp, including account registration data, usage data, and metadata. Meta may use such data for its own purposes, including service improvement and, where applicable and permitted, advertising. We have no control over such independent processing by Meta. For details, please refer to Meta's privacy policy at https://www.whatsapp.com/legal/privacy-policy-eea.

Contact list synchronisation: WhatsApp Business may synchronise the device's contact list with Meta's servers in order to identify which of your contacts use WhatsApp. Where such synchronisation occurs on the device used by us for WhatsApp Business, phone numbers stored in our contact list — including yours — may be transmitted to Meta in hashed form. This process is governed by Meta's terms and privacy policy. We have taken reasonable steps to limit the scope of contact synchronisation.

International data transfers: Meta transfers personal data to servers in the United States of America and other third countries. An adequate level of data protection for such transfers is ensured through the implementation of Standard Contractual Clauses (SCCs) pursuant to Art. 46 para. 2 lit. c GDPR, as entered into between Meta Platforms Ireland Ltd. and its group companies.

Retention: Message histories and contact data are retained for as long as necessary for the purpose for which they were collected — typically for the duration of any coaching or consulting engagement and for a reasonable period thereafter, unless statutory retention obligations require longer storage or you request earlier deletion.

Voluntary use: Use of WhatsApp as a communication channel is entirely voluntary. You may contact us at any time by email instead. Your choice of communication channel will have no bearing on the services available to you.

10. Social Media Presences

We maintain publicly accessible profiles on the following social networks: LinkedIn (LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland), Instagram (Meta Platforms Ireland Ltd., 4 Grand Canal Square, Dublin 2, Ireland), and YouTube (Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland). When you visit our profiles on these platforms, the privacy policies of the respective operators apply. We have no control over the data collected and processed by these providers independently.

Insofar as we have the ability to influence the configuration of the processing of data, we endeavour to make use of it in a data protection-compliant manner. Where processing activities of platform operators cannot be influenced by us, the legal basis for any joint controllership is governed pursuant to Art. 26 GDPR.

Social media buttons on this website are implemented as HTML links only. No connection to the servers of the respective providers is established upon loading this website. A connection is established solely upon active interaction with the respective button or link.

Data transfers to the USA by LinkedIn, Meta, and Google are carried out on the basis of Standard Contractual Clauses pursuant to Art. 46 para. 2 lit. c GDPR.

11. Rights of Data Subjects pursuant to Art. 15–21 GDPR

Insofar as your personal data is processed, you are a data subject within the meaning of the GDPR and you are entitled to the following rights vis-à-vis the controller:

12. Right to Object pursuant to Art. 21 GDPR

Where personal data are processed on the basis of legitimate interests pursuant to Art. 6 para. 1 sentence 1 lit. f GDPR, you have the right to object, on grounds relating to your particular situation, at any time to the processing of personal data concerning you. Where the objection is directed against the processing of personal data for direct marketing purposes, you have the right to object at any time without providing a reason. Following the exercise of your right to object, we will no longer process your personal data for these purposes unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or where the processing serves the establishment, exercise or defence of legal claims. This does not apply where the processing is for direct marketing purposes, in which case we will immediately cease processing your personal data for such purposes.

13. Data Security

We use appropriate technical and organisational security measures (TOMs) in accordance with Art. 32 GDPR to protect your data against accidental or intentional manipulation, partial or complete loss, destruction, or unauthorised access by third parties. Our security measures are continuously reviewed and improved in line with technological developments. Data transfers via this website are secured by means of SSL/TLS encryption.

14. Amendment of this Privacy Policy

We reserve the right to amend this privacy policy at any time with effect for the future in order to adapt it to changed legal requirements or in the event of changes to the service or data processing. The current version is available at any time on this website.
